48 case took 16 days). If the two Judges were to sit on lengthy cases

at Nisi Prius it would clearly involve the dislocation of work on

the Summary side of the Court, Chamber Summonses etc., and it

must be remembered that both Judges are engaged monthly on the

trial of prisoners speaking approximately two days each and the

present state of crime in the Colony has assumed serious pro-

-portions.

As to Your Excellency's alternative suggestion

that it should be optional in an appellant to go direct to the

Privy Council instead of the Full Court I agree that if there is

to be any interim change in the procedure that such a course would

be preferable.

The Secretary of State however in paragraph 3

of his Despatch points out that according to present arrangements

it is proposed to take up later on the question of appointing one

of the Judges of the Shanghai Court to be a member of the Appeal

Court here. A draft Order-in-Council for this purpose was submit-

-ted some two years ago and I understand the subject has been

deferred pending the retirement of the present Chief Justice which

will I assume take place in April of next year when Sir Francis Pi

-gott reaches the age of sixty.
